It is aimed towards youths & adults interested in taking up the battle against curfew laws in their own town, and looking for a place to start or a little ammunition. It's so very, very easy to get around curfew laws. We'll help.


07.23.04 News: Today, a federal judge struck down Indiana's curfew law, as enacted in Marion County, the Indiana Star reports. This is the third ruling against the state curfew, a string of losses that bodes well for curfew fighters nationwide. The repeated rulings are a result of the General Assembly repeatedly revising the law to make it constitutional -- the trouble is that a curfew is inherently unconstitutional, as the losses have shown, so no amount of tinkering (pun intended) will help. The judge agreed with the ACLU, who argued on behalf of 15-year-old Colin Hodgkins (he's now 20) that curfews infringe on the rights of parents to raise their children as they see fit. Note that Indiana has a statewide curfew law, though not all municipalities choose to enforce it.

03.27.01 News: Big news from New Jersey. The ACLU sued the town of West New York over their curfew (Betancourt v. Township of West New York), and they won. Says the attorney for the case, "The proper response to juvenile crime is to arrest the criminals," Kohane said "not to place all law-abiding young people under house arrest." 09.03.00 News: We stumbled across "A Status Report on Youth Curfews in America's Cities" on usmayors.org. It's really very interesting. They surveyed the mayors of 347 cities, with some interesting results. Most interesting is that 80% of surveyed mayors reported a nighttime curfew in their city, and 90% felt that curfew enforcement was a good use of police officers' time. This report is full of great facts and figures, perfect for a school report or general research.

11.11.99 News: Reason Magazine has an article about how "youth curfews are a bad idea whose time has come." It's a fairly straightforward summary of the problems with curfews, and it touches on the D.C. case. A good read.
